The Federal Trade Commission has concluded the North Carolina State Board of Dental Examiners illegally thwarted competition by working to bar nondentist providers of teeth-whitening products and services from selling their products to consumers.
According to a unanimous opinion and final order issued by the FTC on Dec. 2, the Dental Board's conduct constituted concerted action and the board had failed to provide a legitimate pro-competitive justification for its conduct.
